US police officer accused of assaulting Black Army officer fired

Officer Joe Gutierrez has been fired after an investigation showed that he violated police procedure during a traffic stop in which he is accused of assaulting US Army Lieutenant Caron Nazario. Gutierrez pepper-sprayed Nazario, even though his hands were raised and he was not resisting. Nazario filed a lawsuit against the two police officers in federal court for violating his constitutional rights including assault and illegal detention. While he was not charged in the incident, he says the policemen threatened to damage his reputation in the military if he told anyone about how he was treated.
