A maintenance worker was fatally shot by a resident while checking water lines at an apartment complex on Christmas Eve in Texas. The resident thought they were being burglarized and shot through the window from the inside of the apartment out to the balcony. KXAS’ Maria Guerrero reports.

This will be an interesting case.
Unfortunately, one witness will not be able to share his side.
You do have the right to defend your home, even if it’s a rental.
Most rental agreements have a clause about entry when the tenants are not available.
Generally you aren’t supposed to change the locks without sharing a key with management.
If the maintenance personnel are unable to access your apartment with the key available, it is common practice to enter through a window.
This is where the issue probably began.

Absent any prior issues with the tenant and management.
Christmas Day , people aren’t in normal routines.
People don’t want to be called in to work.
The residents may have not been aware there was a problem or not aware that someone was actually working on it.
So if he knocked and the resident didn’t hear him, didn’t recognize him, or got to the door too late and nobody was there, then some guy is coming through the window…..
Most people will be thinking burglary.
If he was frustrated because he got called in on Christmas and in a rush to get home or stop leaks quickly, he may have failed to give proper notice.
Many apartments have washer dryer hookups in the outside storage, or there may be utility access in them.
The actual details and facts of the case may vary.
When renting a property, or owning a property with utility easements, the residents will have to consider that others may have unannounced access to the property…..
Within reason.
It would not surprise me that criminal might not be filed in this case.
There may be a civil case.
But regardless of any judgment, it won’t be fruitful.
Someone renting an apartment generally isn’t in a great financial situation.
The employer of the maintenance man might pay out some.
Ultimately it’s a tragedy that can repeat itself many times over as there is only a narrow window of protection for the residents and the maintenance workers.
Many people don’t realize how many risks exist in common everyday mundane tasks.
Why didn’t management not inform the tenants that there was going to be someone checking on the pipes.
I lived in an apartment like that in the 90s, where the maintenance man just kind of showed up.

You cant shoot if someone is outside your property. First call 911 and inform them, if you are suspicious, get your family in one room and let the person know that you have a gun and warn them, If the person still try to enter into your property then you may shoot if you are under threat.

Terribly sad. All tenants should have received a text alert and a paper statement that someone good would be scratching around the balcony and etc. Because of need to fix or find frozen pipes.

The appartment manager is required to be licensed by the Texas Real Estate Commission. The uneducated manager is required to have written permission to enter the rental unit. The manager murdered the maintaince man with their ignorance. It is against the law to enter or break into private property. So the shooter had every right. If I was family of the deceased I would sue the mamager personally for operating without a license and negligable homacide.

It’s generally not a practice in construction to run water lines through balconies. They tend to be in interior walls, which adjoin multiple apartments to simplify installation and maintenance.

Even if you believe that you are on sound legal footing for discharging a firearm inside your home projectiles can and will go through walls doors windows and continue being dangerous for quite some time so you can legally dispatch a threat inside your home but still be charged for recklessly killing someone outside of the home so keep that in mind before you start pumping rounds through exterior walls windows and doors. Also one of the pillars of firearms safety is never point your firearm at anything or anyone that you’re not willing to destroy so if your target is unknown then should really be pulling that trigger
