So the question is: what is a great number? And must it be proportional to the total group concerned?
Is 1,000+ dead enough or should at least 1% of the population be killed? Or is 5% the minimum threshold for genocide? (see: the normally used p-value in sciences, except physics). Of course over a relative short time span.
I would argue that 5% death of the civilian population is a reasonable threshold to begin to think about genocide; in e.g. Rwanda the number was 800+ KIA’s in 3 months on a relative small population. In WW2 about 4% of the Russian civil population was intentionally killed by Germany; this was not considered genocide.
So, 5% of 2,2 million Palestinians is about 110.000 killed civilians; military KIA’s don’t count here because the goal of war is to destroy the enemy forces (i.c. Hamas).
There are now allegedly around 20K dead Palestinians due to the war that is less than 1% of the total group of Palestinians in the Gaza strip.
ERGO: contrary to the complaint of South Africa (‘s communist regime) lodged with the ICJ, committing “genocide” is not the case in the Israelian-Palestinian war. Hamas has caused a casus belli on October 7th 2023 and Israel responded. Hamas was aware of the fact that the IDF has superior weapons and Hamas was also aware that the Gaza strip is densely populated.
A war of destruction of the opposite military (i.c. Hamas) is not per se illegal. Destruction of the enemies army is one of the goals of war. If the actions of the IDF are in compliance with LOAC the resulting civilian dead constitutes not necessarily genocide. The intention is lacking.
The alleged high number of civilian casualties (collateral damage) in Gaza is mainly the result of the chosen military tactics of Hamas. The fact that the Hamas “combatants’’ use human shields, hide in tunnels under civilian infrastructure and use other illegal (from the point of view of LOAC) tactics leads to the conclusion that the government of the Gaza strip itself is responsible for the high number of casualties under it’s population.
May be it is Hamas that should stop shooting missiles at Israel and surrender to the superior adverse military force if it wants to limit its civilian death number due to collateral damage.
