To balance this reporting with facts, I think it’s important for viewers to know that not all speech is protected by the 1st amendment. In particular, the extrajudicial speech of a criminal defendant is not allowed to prejudice the case in which they are being tried. That’s a well-known standard in the law. It’s the entire reason you hear so many attorneys tell people “I can’t discuss the case outside court”.
Also, So gag orders aren’t controversial. They’re a regular tool used by all courts when defendants or lawyers step out of line with their comments about the case outside of court.
Also, NOBODY has a “superior” 1st amendment right of any kind. EVERYONE is subject to the rules and laws that govern the justice system’s processes and procedures. These are basic facts of law and order – just to keep everyone fully informed, in the context of the reporter’s comments on the current Trump trial.
