All I’m gonna say is, I really hope this doesn’t embolden criminals more than they already are!
The badge is stained. The only way trust can ever be restored in law enforcement is if the following changes are made:
1) end qualified immunity, police are not above the law and need to be held fully accountable for their actions, just like everyone else is in their job or profession.
2) require police to have their own insurance so if a cop breaks the law and is sued, it is not taxpayers footing the bill but the guilty officer and their insurance provider. if a cop has a pattern of bad behavior and is sued too many times, their insurance rates will rise, and if they can no longer afford those rates they lose their job.
3) require that every case of police misconduct and abuse of power is investigated by a THIRD PARTY investigatory body and not the department itself. police will always look out for their own interests and if we continue to allow law enforcement agencies to investigate their own actions it will only continue the pattern of corruption and abuse.
4) raise the requirements needed to become a police officer. where it stands now, it takes more education and training to become a hairstylist than it does to become a cop. in the early 2000’s the Supreme Court passed a law allowing law enforcement to hire only low IQ applicants. this has without a doubt been a major contributing factor to police abuses as unintelligent officers are more likely to act without thinking and abusing their power. require college education and at least two years of training to become a LEO.

It will be corrupt as long as people like you tolerate the corruption. You are the problem. I’m not trying to be all high and mighty. @Mets2015WorldSeries You think police should never be held liable for misconduct or abuse of powers because sometimes people sue them for stupid things? That’s entirely broken logic and essentially makes them above the law. If a cop gets sued for a traffic stop and there is actual grounds for damages, the court will decide that matter. If there is no point to the suit and it’s done frivolously, the courts can order that the plaintiff pay the cop’s legal fees – which is exactly how it works for every other lawsuit in this country. Cops don’t deserve special treatment.

Qualified immunity does not protect officials from clear violations of constitutional rights, nor does it protect officials from violations of clearly established statutes that a reasonable person would’ve been aware of. It also does not prevent officials from being criminally charged for their actions.

@isrulius qualified immunity is a doctrine designed to protect officials from civil suits arising from discretionary actions made in the course of their duties. That protection, however, does not apply in cases of clearly established, intentional violations of constitutional rights or clearly established law.
Further, qualified immunity is only given to those who have met a certain training and education standard set by a higher authority, usually a state or commonwealth legislative body.
Whether that training and education standard is acceptable is entirely subjective, and it’s perfectly reasonable to argue that the bar may be set to low.
However, to sit there and whine “qualified immunity BAAAAAD” without actually knowing how the legal principle actually works is downright asinine.
Brothers are wiping out each other here in Chicago, and it’s not the Chicago PD doing the killings.
They are ruining this country. Thankfully they ban together inside inner cities and wipe each other out.

A fundamental problem is that the constitution does not give the federal government any power over state police forces.
It would be good for the Supreme Court to strike down qualified immunity, but the heavy lifting has to be done by the state governments.

The Supreme Court developed qualified immunity as part of its interpretation of the Civil Rights Act of1871 (also known as the Ku Klux Klan Act). The portion of that statute now codified in Section 1983 provides a cause of action for “the deprivation of any rights, privileges, or immunities secured by the Constitution and laws” by any person acting “under color of any statute, ordinance, regulation, custom, orusage, of any State or Territory.” As applied to the conduct of police officers, Section 1983 provides alegal remedy for individuals claiming that their constitutional rights, such as the right to be free fromexcessive force under the Fourth Amendment, were violated by state or local police acting pursuant tostate or local law. According to the Supreme Court, Section 1983 is a “vital component … for vindicating cherished constitutional guarantees,” as the law has been viewed much like common law tort claims that deter wrongful actions.
The Supreme Court has set forth a two-part analysis when determining whether an official is entitled to qualified immunity: (1) whether the facts alleged by the plaintiff amount to a constitutional violation, and (2) if so, whether the constitutional right was “clearly established” at the time of the misconduct. (Some circuit courts also include a third prong, which asks whether the conduct was “objectively reasonable” inlight of clearly established law, but the Supreme Court has not expanded its two-part analysis to date.) Both conditions must be met for a suit against the official to proceed. Conversely, if either condition isabsent, then the official is immune from suit. The Supreme Court grants courts the discretion to decide
which prong to first address in light of the circumstances of the facts of the case at hand. Whether a rightis clearly established depends on whether “the contours of a right are sufficiently clear” so that every“reasonable official would have understood that what he is doing violates that right.” When conducting this analysis, courts look to see whether it is “beyond debate” that existing legal precedent establishes the illegality of the conduct.”
